Handcuffing Chhatra League Leader at His Mother’s Funeral and Shackling a Shibir Leader Violates Human Rights – HRSS

On December 10, Human Rights Support Society (HRSS) strongly condemned, protested, and expressed concern over the incidents involving handcuffing Jahangir Hossain, a leader of the banned student organization Chhatra League, at his mother’s funeral, and shackling Mohsin Alam, the former president of Natore District Chhatra Shibir, while he was taken to court for a regular appearance. HRSS stated that such incidents are a clear violation of human rights.

In a statement issued on December 12, signed by HRSS Executive Director Ejazul Islam, the organization expressed its disapproval and concern over these events.

According to media reports, Jahangir Hossain, former vice-president of Chuadanga Municipal Chhatra League, has been in custody since November 12, facing charges under the Explosives Control Act related to sabotage. On December 10, at 8 a.m., Jahangir’s mother, Aleya Khatun (70), passed away due to a stroke. Jahangir’s family applied for parole to attend his mother’s funeral, and permission was granted from 1 p.m. to 5 p.m. On his release, Jahangir was escorted by police to his home. Despite the circumstances, he was forced to carry his mother’s body while still wearing handcuffs and participated in the funeral and burial. Images and videos of him wearing handcuffs during the funeral spread on social media. On the same day, Mohsin Alam, the former president of Chhatra Shibir in Natore, was shackled and brought to court for a regular appearance at the District and Sessions Judge’s Court. His shackled image also went viral on social media.

HRSS’s statement further expressed that during Jahangir’s participation in the funeral and burial, keeping him in handcuffs was a disrespectful act that violated his religious sentiments and traditions. This act was not only inhumane but also a clear violation of Articles 5 and 18 of the Universal Declaration of Human Rights and basic human rights principles as outlined in the Constitution of Bangladesh. According to Article 35(5) of the Constitution, no person shall be subjected to torture or cruel, inhuman, or degrading punishment. HRSS believes that the High Court’s guidelines regarding shackling were not properly followed in Jahangir’s case, and similar violations occurred in the case of Shibir leader Mohsin. The relevant authorities could have taken alternative measures, such as increasing security personnel or imposing stricter surveillance, to ensure safety. Such incidents were also common under the previous regime of Prime Minister Sheikh Hasina. It is disheartening and shameful to witness these events in post-revolution Bangladesh.

HRSS demanded legal action against those involved in these incidents and called for necessary steps to be taken to prevent such occurrences in the future. The organization urged the authorities to take appropriate measures to ensure such inhumane actions do not repeat.
